Second and Final Special Members Meeting

The Second and Final Special Members Meeting - The Association is going to attempt to hold the "Second and Final Call" of the Special Members Meeting where Members will vote to increase the assessments from 3% to 5% for fiscal year 2024 to enable the Association to lease enough Flock cameras to cover each entrance to the community. At the first call for a Special Members Meeting quorum was not achieved. According to our Governing Documents Quorum is reduced for the second and final called meeting from 542 to 271 ballots. A minimum of 271 ballots must be received for the second meeting or there will be no quorum and the votes will not be able to be counted. At present the Association needs approximately 106 more ballots to be able to hold the meeting. Meeting will be scheduled for immediately after HOA election on October 21st, 2023. The vote has remained open since the first meeting. If you have already cast a ballot on this issue your original ballot remains valid.

It would be nice if we could do just one thing to enhance security and go to bed knowing we have done everything we could. Unfortunately, in the real-world security is multi-leveled and ever changing. The license plate readers are being offered as an additional level of protection to assist our understaffed and overworked law enforcement agencies develop leads to solve crimes should they happen. 80% of property crime and over 50% of violent crime goes unsolved due to the lack of leads. Every week we see news reports where criminals have been caught because of the license plate readers. The bottom line is that the cameras work. Because of inflation the Board will have to increase assessments for 2024 by 3%. The Board is asking for permission to increase the assessment an additional 2% ($10.09 per household) to assist in the funding of the cameras.

An official notice for the second meeting will be mailed to each Homeowner’s address of record. NOTICE OF SPECIAL MEETING OF MEMBERS OF OAKWOOD GLEN COMMUNITY - TO FUND FLOCK CAMERA’S

This is a public notice to all members of the Oakwood Glen Community Association, (the “Association”) to advise of an upcoming Special Meeting. In order to conduct business, a quorum must be present either in person or by proxy. Please note that the quorum requirement is the presence, in person or by proxy, of owner-members representing 60% or 542 homeowners, of the total votes in the Association.

In accordance with Article IV, Section 3(a) of the Declaration of Covenants, Conditions and Restrictions of Oakwood Glen Community “the maximum annual assessments may be increased each year not more than 3% without a vote of the Membership”. The Board is calling for this Special Meeting of the Membership for the express purpose of increasing the 2024 Assessment by 5% to facilitate the funding of license plate reader cameras to cover all 9 exits of the Oakwood Glen Community at an annual lease price of $2,400 per camera ($21,600 per year). In the interest of full disclosure, should this proposal fail the Board will still be obligated to increase the 2024 Assessment by 3% to cover inflation. If approved the net increase to each Homeowner would amount to an additional 2% increase ($10.09 per year). A Town Hall Meeting has been scheduled prior to the Special Meeting to ensure that homeowner’s questions are answered.

Pursuant to Article IV, Section 5 of the Declarations, the quorum for a meeting at which the Association will vote to raise assessments above three percent (3%) is “the presence of members or proxies entitled to cast sixty percent (60%) of all votes of each class of membership.” Quorum for this meeting is (903 lots X 60% = 542 quorum) members participating. For the proposal to pass requires that 2/3 (67%) of the quorum vote in favor (542 X 67% = 363 votes). If quorum is met then the results of the vote are final. If quorum is not met then our governing documents allow for a second Special Meeting to be called. At this second meeting the quorum is reduced by 50%. (542 X 50% = 271 quorum) to establish quorum. For the proposal to pass in the second meeting requires a 2/3 vote of the revised quorum (271 X 67% = 182 votes).
